RESTORATION OF VOTING RIGHTS FOR CONVICTED FELONS

New Mexico residents with felony convictions, who have completed their sentences, have the right to vote,
provided that they have completed their sentence, in its entirety, including any period of probation and/or parole.

The 2005 amendment to New Mexico statute 31-13-1 requires the district court clerk to notify the secretary of state when
a person has completed the terms of a suspended or deferred sentence, and the secretary of state to notify all county clerks
that the person is eligible for registration. Once a person has completed a sentence imposed for a felony conviction, including
all terms of parole and probation, the New Mexico Corrections Department must issue a certificate of completion to that person.
The certificate shall state the person's voting rights are immediately restored. Whenever a certificate of completion is issued,
the New Mexico Corrections Department shall notify the secretary of state. The secretary of state shall notify all county clerks
that the person is eligible for registration and county clerks shall accept the certificate of completion as proof that the person is
eligible for registration.

WHO CAN VOTE?

Any convicted felon, residing in New Mexico, who has completed his/her sentence, including all parole and probation terms,
through the New Mexico Corrections Department Probation and Parole Division, has the right to vote in any state, federal or local election.

WHO DOES THAT INCLUDE?

An individual who:
• has completed the requirements of a suspended or deferred sentence; or
• received a conditional discharge and has satisfied all requirements of the conditional discharge; or
• has completed his/her sentence, including parole and probation while in prison or through the New Mexico Corrections Department Probation and Parole Division.

WHEN IS A CERTIFICATE OF COMPLETION ISSUED?

• When an individual completes his/her entire sentence, including any term of parole and probation, within the confines of a penitentiary,
he/she shall receive a certificate of completion from the prison records manager.
• When an individual completes his/her parole and probationary term, he/she shall receive a certificate of completion from the probation and parole officer.

WHAT IF I DON'T HAVE MY CERTIFICATE OF COMPLETION?

Individuals who completed their sentence within confines of penitentiary:

• The request must include the following information: ex-offender's name (including all aliases), date of birth, social security number,
and the New Mexico Corrections Department inmate number.

• Individuals convicted in Bernalillo County, excluding intensive supervision, community corrections and sex offenders,
should submit their request to Bill Tennant, Region II, Standard Supervision supervisor.
• Intensive supervision, community corrections and sex offenders convicted in Bernalillo County should submit their request
to Michael Hartman, Region II, Special Programs supervisor.
• All Individuals convicted in Valencia or Sandoval County should submit their request to Michael Hartman, Region II Special Programs supervisor.

HOW DO I REGISTER TO VOTE?

Bring a copy of your certificate of completion to the county clerk's office in the county where you reside.
Upon verification of your eligibility, the clerk will register you to vote.

WHAT IF I COMPLETED MY SENTENCE IN ANOTHER STATE?

Ex-offender must present the county clerk with a judgment and sentence from the state or federal sentencing jurisdiction.
The county clerk shall accept the judgment and sentence as sufficient proof of voter eligibility, provided that from its face value,
the length of sentence can easily be determined and the date that sentence should have terminated has clearly passed.

DOES A PERSON HAVE TO GET A CERTIFICATE OF RELIEF FROM CIVIL DISABILITIES
(ALSO KNOWN AS A PARDON) FROM THE GOVERNOR IN ORDER TO VOTE?

No. An ex-offender is automatically eligible to vote in New Mexico upon completion of his/her sentence in its entirety.
