Order, Delivery, and Billing Information

Under Section 13-1-189 NMSA 1978 Wherein it Reads in Relevant Part That:

     "All state agencies SHALL PURCHASE and all local public bodies may purchase items of tangible personal property and services offered pursuant to the provisions of the Corrections Industries Act.  The Corrections Industries Commission shall prepare a catalogue containing an accurate and complete description of all items of tangible personal property and services.  A copy of the catalogue shall be provided to each state agency and local public body.  The catalogue shall contain an approximate time required for delivery of each item of tangible personal property and service."

 The section of the statute further provides that:

    "The State Purchasing Agent or central purchasing office SHALL PURCHASE available items of tangible personal property and services from the catalogue unless a determination is made that:

  1. An emergency exists requiring immediate action to procure the items of tangible personal property or services;
  2. The specifications for the items of tangible personal property or service, including quality, quantity, and delivery requirements, cannot be met within a reasonable time frame by the Corrections Department.
  3. The price to be paid to the Corrections Department for the items of tangible personal property or services is higher than the bid price of comparable items of tangible personal property or services."

Agencies are also reminded of Section 13-1-98(A) NMSA 1978 which state in relevant part that "The provisions of the Procurement Code shall not apply to procurement of items of tangible personal property of services by state agency or local public body from a state agency [or] local public body..."  This provision allows for direct purchase by any state agency from Corrections Industries without the need for initiating a formal procurement process.

Ordering:

    Orders may be placed through your sales representative, or via U.S. Mail.  Work Orders will be processed upon receipt of the original purchase document.  Faxed purchase documents are accepted.  Please use the correct vendor code (00000544844) on all purchase documents submitted to Corrections Industries. Please include the correct catalog number, your wood stain selection, fabric selection (When applicable), price, and date of referenced price list.  State Agencies must show the purchase order number, encumbrance number, and an authorized signature.  Private nonprofit organizations must include a nontaxable transaction certificate.

Delivery

   Corrections Industries will charge 10% of the invoiced amount for delivery.  Purchase orders that do not include a 10% delivery charge will be rejected.  Corrections Industries reserves the right to impose a 15% 'rush' charge on orders requiring delivery within ten (10) business days.  Delivery charges on printing services are charged at current UPS rates.

Billing:

    Corrections Industries reserves the right to ship and invoice partial deliveries. Invoices are processed upon delivery of products and services. A late fee of 1.5% per month will be charged on all past due invoices.

Warranty:

   New Mexico Corrections Industries guarantees our products to be free of defects in materials and craftsmanship for a period of one (1) year from the date of shipment.  Products requiring service after the warranty period will be prorated.  Goods damaged during delivery must be documented on the delivery ticket upon receipt.  All warranty claims must include the delivery date and the relevant work order number.  Any repairs and/or replacements must be authorized by the Division Director.

Order Changes or Cancellations:

  Changes and cancellations are costly and time consuming.  Once a work order is generated, it is immediately queued for production.  Materials are purchased based upon pending work orders.  Any modification or cancellation of a work order is subject to a 20% service charge.  Positively no changes or cancellations on custom orders.

Returns:

    No return of product will be accepted unless authorized in writing by the Sales Manager.
